Tri-Lakes Wastewater Treatment Facility Joint Ownership
In 1977, Woodmoor Water & Sanitation District #1, Palmer Lake Sanitation District and Monument Sanitation District (participating Districts) entered into an agreement for the joint operation and use of a sewer treatment facility (the Facility).
In 1988, by amendment to the original agreement, Woodmoor Water & Sanitation District #1 began management of the plant facility in accordance with the policies and procedures for joint use established by the coordinating committee.
In 1996, the three participating Districts entered into an Amended Joint Use of Facilities Agreement (AJUA), which replaced all prior agreements with regard to management of the facility. Since the enactment of the AJUA, the Facility is a joint venture of the participating Districts and is managed by a Joint Use Committee comprised of one member from each District. The real and personal property and fixtures of the facility are commonly owned by the districts in equal, undivided one-third interests, with each District possessing the right to use the real estate.
Operating expenses are billed to the respective Districts on a monthly basis in accordance with each District's pro rata contribution to the monthly flows and BOD loadings discharged into the facility. Each calendar month, forty percent of operating expenses will be billed by influent flows and sixty percent of operating expenses are billed by BOD loadings. The capacity is subject to change with future facility expansion.
The Facility's capacity, since November 9, 1999, is allocated 64.28% to the District, 19.79% to Monument and 15.93% to Palmer Lake, and is subject to change with future Facility expansions.
